1. Introduction

Welcome to Lowbrow Art, an AI-powered image generation application. These Terms of Service ("ToS") are a legal contract between you, the user, and Lowbrow Art ("we", "us", or "our"), governing your use of the Lowbrow Art application and services.

2. Acceptance of Terms

By creating an account, downloading, installing, or using Lowbrow Art, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use Lowbrow Art.

3. Eligibility

You must be at least 13 years of age to use Lowbrow Art. Users under 18 must have permission from a parent or legal guardian.

4. User Accounts

You are solely responsible for the text inputs you use to generate images and any content you create, share, or display on or through Lowbrow Art.
You must not use Lowbrow Art to create, share, or display:
  • Illegal or unlawful content.
  • Infringing content that violates intellectual property rights.
  • Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
  • Content that violates privacy or publicity rights.
Lowbrow Art reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS.

7. Intellectual Property Rights

The images generated by Lowbrow Art are derivative works created by AI. You are granted a limited, non-exclusive, non-transferable license to use images generated by Lowbrow Art for personal, non-commercial purposes.

8. License Grant to Lowbrow Art

By using the Services, you grant to Lowbrow Art, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts you input into the services, or images produced by the service at your direction. The license granted to Lowbrow Art remains in effect even after termination of this Agreement by any party, for any reason.

9. Privacy Policy

Your use of Lowbrow Art is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

10. Limitation of Liability

Lowbrow Art and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

11. Changes to Terms

Lowbrow Art reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

12. Termination
